CONTRACT FORMATION
Submission of an order, online or by email, along with making payment for the same constitutes an agreement to purchase. We will always try to send you an email acknowledging your order following your email contact, but irrespective of the receipt of such, your order has been accepted at this point and a binding contract is formed between you and us. If we are unable to supply you with a product, for example because the materials required to produce that product are no longer available, we will inform you of this as soon as possible by email and you will be entitled to either change or cancel your order. In all other cases, and especially once production have commenced upon your order it will be treated as final.
PERSONALISATION OF PRODUCTS
By supplying your artwork you confirm that you have the right to do so and that the artwork does not infringe the rights of any other person or entity. By doing so you fully indemnify us and hold us harmless against any claim, costs, losses and expenses (including legal fees) that arise out of a claim that the artwork infringes the rights of any third person. You must not upload or submit any artwork for customising a product that is copywritten (unless you are fully licenced by the copyright owner for its use) or which infringes in any other way anyone's rights (including intellectual property rights). We retain the right to refuse to process, or to terminate our contract with you (without liability) if we have good reason to believe that you have submitted artwork that you do not have the right to use.
By supplying artwork you grant us a licence, at no cost, to use, reproduce, adapt, and publicise that artwork for the purposes of producing your purchased product and to enable us, unless you have formally requested that we not, to advertise our products and services to the public.
We will endeavour to reproduce the sizing and colours of the artwork as closely as possible, choosing the closest colour match possible, but we are unable to guarantee that the colours will be an exact reproduction of the artwork, and the advertised sizing on our website - rather than on your artwork or any supplied 'layout' image - will govern the size of printing. Where you have supplied artwork, the quality of the print may be dependent on the quality of the artwork received. However we will endeavour to always message you first should we have reason to believe the colour, size and/or quality of the supplied artwork is likely to cause an issue and would not give a good end result. Please double-check your artwork before supplying it, as you will be unable to make changes after printing has commenced.
DELIVERY
We will deliver the products to the address specified by you when placing your order, so long as you provide a valid address for delivery and have paid the relevent delivery charge. The delivery method we use may depend on the delivery address and the size of the order.
We aim wherever possible to despatch products within the lead times indicated on the individual product pages on our website. However, all our products are handmade and bespoke, and delays can occassionly occur. As such we consider these delivery dates as estimates only, and will not be liable for any delays caused by, but not limited to, transportation issues, delays in receipt of material, accidents or other causes beyond our control. Nor will we be liable for the consequences of, or any costs incurred due to, any delay. If we are unable to deliver the products within, or close to the indicated timescale, we will use reasonable efforts to let you know and give you an amended delivery estimate.
We strongly advise that you order products well in advance of the date by which they are required and give us prior warning of any date on which you wish to use the product, even if this date is outside of the quoted lead time.
We will notify you by email with tracking details if applicable when the products are dispatched. The carrier will then usually be in touch with more detailed delivery information, and it will be your responsibility to ensure that if you are not available to take delivery of the products at the time the carrier specifies, you rearrange delivery with the carrier. If the carrier is unable to deliver the products to you and they are subsequently returned to ourselves, we reserve the right to charge you for the cost of redelivering the products.
If You order more than one product, We may deliver the products in multiple installments.
INTERNATIONAL DELIVERY
If You order products from our website for international delivery, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. We have no control over these charges and we cannot predict their amount. You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information if required before placing an order for international delivery.
PRICES AND PAYMENT
The price of our products are as published on the website when we receive your order. As we are below the threshold for VAT, prices displayed neither include nor will have VAT added. All applicable delivery charges are as stated on the website or as specified by email at the time you place your order. There are no setup or artwork charges beyond the prices advertised on the individual product pages.
Prices for all products may change from time to time, but changes will not affect any order you have already placed. If we discover an error in the price of the products you have ordered, we will contact you to inform you of this error and if agreement cannot be reached to purchase the product at the correct price, we will cancel your order. Please note this applies if the pricing error is obvious and unmistakeable and could have reasonably been recognised as a mispricing. We accept payment by bank transfer or cheque and dependent on product by Visa, Visa Delta, Visa Electron, Mastercard & Maestro. Please be aware that our acceptance of your order is conditional on receiving full payment for the Products and therefore we will not process your order until payment has been received.
DISCOUNTS AND OFFERS
We may offer discounts and offers from time to time at our discretion. We will always stipulate an expiry date for a discount or offer and to qualify your order must have been placed and paid for by the relevant expiry date . We reserve the right to amend or terminate the discount or offer early where circumstances outside of our control make this necessary.
CANCELLATION AND REFUND
All our products are custom made and/or personalised and you do not have a legal right to cancel, as such all sales are considered final and we operate A NO REFUND and NO CANCELLATION Policy on any order that is manufactured by us.
Refunds will only be issued should we be unable to supply an ordered product.
FAULTY PRODUCTS
In the very rare instance that a product is deemed to be of unacceptable quality we ask that customers contact us by email in the first instance with as much information and pictures if possible. We will then agree a way forward at that point. We have a repair or replace policy if there is a genuine defect, but will require the item to be returned.
We will supply a return address or arrange collection once we have accepted an item for return, please do not return items without/before authorisation as we cannot guarentee that these will be dealt with in a timely manner.
Please note that colours and appearances of products and artwork on computer, tablet or mobile device screens may vary slightly and may not accurately reflect the products or the artwork delivered. Any slight variations in the colour of the products (including slight variations in the colour of printed artwork) will not count as a defect. If a precise colour match is imperitive please request a colour swatch prior to proceeding. Please also make sure that you are happy with, and understand the measurements given on the website for Products before you place your order, as an incorrect size when the size matches that advertised on the website will not count as a defect.
Our limit of liability for any and all losses resulting from defective goods will be the replacement or repair of the same. Your right to a repair or replacement will be conditional on the defect or fault not having been caused by usual wear and tear, deliberately or accidentally, or by your negligence or misuse of the Product.
OUR LIABILITY
Nothing in these terms will limit or exclude our liabilities under the law. We will however, under no circumstances, be liable to you, for any real or calculated loss of profits, sales, business, or revenue; loss or corruption of data, information or software; loss of business opportunity; loss of anticipated savings; loss of goodwill; or any indirect or consequential loss. Our total liability in respect of all losses arising under or in connection with the contract, shall in no circumstances exceed the total amount paid under the contract. In placing an order for products advertised on our website, you agree that you will not have any claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in the contract.
EVENTS OUTSIDE OUR CONTROL
We will not be liable to you for any delay or failure in the performance of our obligations under the contract to the extent that such delay or failure results from circumstances, acts or events beyond our reasonable control, including without limitation, traffic, weather, war, terrorism, riots, civil unrest, fire, flood or other acts of God, industrial action, strikes or lock-outs, failure or delay of supplies of power, fuel, transport, equipment or other goods or services for which a substitute is not available (an "Event Outside Of Our Control").
If such an event takes place that affects our ability to perform our obligations under the contract, we will endeavour to contact you as soon as reasonably practicable and our obligations under the contract will be suspended and the time for performance of our obligations will be extended for the duration of the event outside of our control.
VARIATION
We may from time to time vary these terms and conditions. When we accept an order from you, the terms in force at the time of your order will apply.
